Participant Waiver, Release of Liability, and Indemnification Agreement

PLEASE READ CAREFULLY. BY CLICKING “I AGREE” AND/OR SIGNING UP FOR AN ACCOUNT ON THE KTAC WEBSITE, YOU ARE SIGNING A LEGAL DOCUMENT THAT AFFECTS YOUR RIGHTS.

1. ASSUMPTION OF RISK / 위험 인지 및 감수
Participant acknowledges that participation in classes, workshops, performances, rehearsals, and related activities (collectively, “Activities”) involves inherent risks such as bodily injury, illness, property damage, or death.
참가자는 수업, 워크숍, 공연, 리허설 및 기타 관련 활동(이하 “활동”)에 참여함으로써 신체적 부상, 질병, 재산 손해, 사망 등의 위험이 수반됨을 인지하고 자발적으로 모든 위험을 감수합니다.

2. RELEASE AND WAIVER OF LIABILITY / 책임 면제
Participant (and Parent/Guardian, if applicable) hereby releases and discharges Koreatown Art Center (KTAC), its officers, directors, employees, agents, instructors, volunteers, and affiliates (collectively, the “Released Parties”) from any and all claims, demands, or causes of action related to injury, illness, or property damage arising from participation in KTAC Activities, including those caused by negligence.
참가자(또는 법정 보호자)는 Koreatown Art Center (KTAC) 및 그 임원, 직원, 강사, 자원봉사자 등(이하 “면책 당사자”)이 활동 중 발생할 수 있는 모든 부상, 질병, 손해에 대해 법적 책임을 묻지 않으며, KTAC의 과실이 포함된 경우에도 이를 포기합니다.

3. INDEMNIFICATION / 면책 및 보상 의무
Participant (and Parent/Guardian, if applicable) agrees to indemnify, defend, and hold harmless KTAC and the Released Parties from any and all claims, damages, or expenses (including attorneys’ fees) arising from or related to: (a) participation in Activities; (b) any act or omission by Participant (or minor Participant); or (c) any breach of this Agreement. This obligation applies even if such claims arise from alleged negligence of KTAC, except where caused by gross negligence or willful misconduct.
참가자(또는 법정 보호자)는 (a) 활동 참여, (b) 참가자(또는 미성년자 참가자)의 행위 또는 부작위, (c) 본 동의서 위반으로 인해 발생하는 모든 손해나 비용(변호사 비용 포함)에 대해 KTAC 및 면책 당사자를 면책하고 방어하며 손해를 보상할 것에 동의합니다. 단, KTAC의 중대한 과실이나 고의적인 위반으로 인한 경우는 제외됩니다.

4. MEDICAL AUTHORIZATION / 의료 조치 동의

Participant (and Parent/Guardian) authorizes KTAC to seek and obtain emergency medical treatment deemed necessary and agrees to be financially responsible for any associated costs.
참가자(또는 법정 보호자)는 KTAC가 응급 상황 시 필요한 의료 조치를 취할 수 있도록 허가하며, 발생하는 비용에 대한 책임을 집니다.

5. CONSENT TO USE IMAGE, VIDEO, AND AUDIO / 이미지, 비디오 및 오디오 사용에 대한 동의
I grant KTAC the right to photograph, record, or otherwise capture my or my child’s image and voice during KTAC activities.
KTAC가 수업, 행사 또는 활동 중 본인 또는 자녀의 사진, 영상, 음성을 촬영하거나 녹음하는 것에 동의합니다.

KTAC may use these materials for promotional, educational, or informational purposes in the following media:
KTAC는 다음과 같은 홍보, 교육, 정보 목적의 매체에서 이를 사용할 수 있습니다:
- Website / 웹사이트
- Social media (Instagram, Facebook, TikTok) / 소셜 미디어 (인스타그램, 페이스북, 틱톡)
- Printed materials / 인쇄물
- Presentations / 발표자료

I waive the right to review or approve the materials and understand that no compensation will be given. All materials will remain the property of KTAC.
완성된 자료를 사전에 검토하거나 승인할 권리를 포기하며, 보상을 받지 않을 것에 동의합니다. 모든 사진 및 영상 자료의 소유권은 KTAC에 있습니다.

6. MINOR PARTICIPANTS / 미성년자 참가자
If the Participant is under 18 years of age, the Parent/Guardian confirms they have legal authority to consent, and agree that all terms of this Agreement apply equally to both the minor and the Parent/Guardian.
참가자가 만 18세 미만인 경우, 법정 보호자는 본 동의서에 동의할 법적 권한이 있으며, 본 동의서의 모든 조항이 보호자와 미성년자 모두에게 동일하게 적용됨을 인정합니다.

7. GOVERNING LAW / 준거법
This Agreement shall be governed by the laws of the State of California, and any disputes shall be resolved in Los Angeles County, California. Any and all ambiguities between the English and Korean verbiage in this Agreement shall be resolved by the English version of the terms.
본 동의서는 캘리포니아 주법에 따라 해석되며, 모든 분쟁은 로스앤젤레스 카운티 법원의 전속 관할로 합니다.

8. SEVERABILITY / 조항의 분리 가능성
If any portion of this Agreement is held invalid, the remainder shall remain in effect.
본 동의서의 일부 조항이 무효가 되더라도 나머지 조항은 계속 효력을 가집니다.

9. ACKNOWLEDGEMENT AND ELECTRONIC CONSENT / 확인 및 전자 서명 동의

By clicking "I AGREE" and/or signing up for an account on the KTAC website ,” Participant (and Parent/Guardian, if applicable) acknowledges they have read and understood this Agreement, and voluntarily agree to its terms. This electronic action constitutes a legally binding signature.​

“동의합니다(I AGREE)” 버튼을 클릭함으로써 참가자(또는 보호자)는 본 동의서의 내용을 충분히 이해하고 자발적으로 이에 동의함을 확인합니다. 본 전자 동의는 법적 효력을 갖는 서명으로 간주됩니다.
